Terms & Conditions

Welcome to The Donut (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of www.thedonut.tv and any related apps, players, or services we provide (collectively, the “Service”). By visiting the Site, creating an account, streaming content, purchasing a subscription, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and are fully able and competent to enter into these Terms.
 

2. Account Registration

  1. Accuracy – You agree to provide true, complete, and current information when creating an account and to keep that information updated.

  2. Security – You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately of any unauthorized use.

  3. One Account – We reserve the right to limit users to one active account and to refuse, suspend, or terminate any account at our discretion.

3. Subscriptions & Payments

  1. Subscription Plans – Certain content and features require a paid subscription. Plan details, pricing, and renewal terms are displayed during checkout and in your account settings.

  2. Billing – Subscriptions renew automatically at the end of each billing cycle unless you cancel before renewal. By providing a payment method, you authorize us and our payment processor to charge all subscription fees and applicable taxes.

  3. Cancellation – You may cancel anytime from your account dashboard. Cancelations take effect at the end of the current billing period; no refunds are issued for unused time.

  4. Price Changes – We may change subscription fees with 30 days’ notice via email or through the Service.
     

4. Intellectual Property

  1. Our Content – All shows, videos, text, graphics, logos, and other materials provided through the Service (“Company Content”) are owned by or licensed to The Donut and are protected by copyright, trademark, and other laws. Except as expressly permitted, you may not copy, reproduce, distribute, or create derivative works from Company Content without our prior written consent.

  2. Limited License – Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable license to access and view Company Content for your personal, non‑commercial use.

  3. User Content – If you upload, post, or transmit any content (“User Content”), you grant us a worldwide, royalty‑free, sublicensable license to use, reproduce, distribute, and display such User Content in connection with the Service. You represent that you have the rights necessary to grant this license.
     

5. Acceptable Use

You agree not to:

  • Reverse‑engineer, decompile, or disassemble any part of the Service.

  • Circumvent DRM, geographic restrictions, or any technical protections.

  • Share your account credentials or stream simultaneously to users outside your household.

  • Upload or transmit content that is unlawful, defamatory, obscene, or infringes intellectual‑property rights.

  • Use the Service to stalk, harass, or threaten others, or to promote violence or hate.

  • Interfere with or disrupt the Service or servers.

Violation may result in suspension or termination of your account.
 

6. Third‑Party Services

The Service may link to or integrate with third‑party platforms (e.g., payment gateways, social networks). We are not responsible for third‑party content or practices; your interactions with such services are governed by their terms.
 

7. Termination

We may, with or without notice, terminate or suspend your access if we believe you have violated these Terms or pose a risk to the Service or other users. You may terminate your account at any time. Sections 4, 8–12 survive termination.
 

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR‑FREE, OR SECURE.
 

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DONUT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTly, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT.
 

10. Indemnification

You agree to indemnify and hold harmless The Donut, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or in any way connected with your use of the Service or violation of these Terms.
 

11. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Washington, USA, without regard to its conflict‑of‑law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Pierce County, Washington.
 

12. Dispute Resolution (Optional Arbitration)

At our discretion, we may require you to submit any disputes arising from these Terms or use of the Service to final and binding arbitration under the Rules of the American Arbitration Association.
 

13. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” and, if changes are material, notify you via the Service or email. Continued use after changes constitute acceptance of the revised Terms.
